FAQ

Driver FAQs

1. What happens if I fail a DOT drug or alcohol test?

If you fail or refuse a DOT drug or alcohol test, you must complete the DOT return-to-duty process with a qualified Substance Abuse Professional (SAP) before you can legally return to safety-sensitive CDL work.

2. What is the DOT SAP program?

The SAP program is a required evaluation, education, and treatment process for CDL drivers who violate DOT drug and alcohol regulations. A SAP evaluates the driver, recommends education or treatment, determines successful compliance, and sets the follow-up testing plan.

3. How long does the return-to-duty process take?

It depends on your individual case and on how quickly you complete the recommended education or treatment. Working with an experienced SAP can help you move through the process as quickly as possible while staying DOT-compliant.

4. Do I need to register with the FMCSA Clearinghouse?

Yes. Drivers generally need a Clearinghouse account to manage consent and access information tied to the return-to-duty process and employer queries. The Clearinghouse is the official FMCSA database for CDL driver drug and alcohol program violations.

5. How do I find a SAP in the Clearinghouse?

You can search for a qualified SAP in the FMCSA Clearinghouse. Many drivers choose to work with Scott Roberts, a qualified SAP, for guided, step-by-step support through the process.

6. Can I drive again after completing the SAP program?

Yes. Once you complete all required steps, the SAP determines you have successfully complied, and your employer chooses to return you to safety-sensitive duties, you must take a return-to-duty test before resuming those functions.

7. Will the SAP clear me immediately?

No. A SAP does not “automatically clear” a driver. The SAP must evaluate your case, make recommendations, determine successful compliance, and establish a follow-up testing plan before the return-to-duty process can conclude.

8. How much does the SAP program cost?

Costs vary depending on your individual situation and the level of education or treatment recommended. We provide clear, upfront pricing with no surprises. Contact us for a quick consultation.

9. Will my employer be notified?

Yes. DOT regulations require reporting in the Clearinghouse, and employers use the Clearinghouse for required queries and return-to-duty reporting. We guide you through the process so everything is handled correctly and professionally.

10. What if I don’t currently have an employer?

You may still need to complete parts of the return-to-duty process and Clearinghouse requirements before you can return to safety-sensitive work. If you are between employers, we can help explain your next steps based on your situation.

11. What is a return-to-duty test?

A return-to-duty test is the test required before an employer can allow a driver back into safety-sensitive duties after a violation and successful SAP compliance.

12. What is follow-up testing?

After successful SAP compliance, the SAP establishes a follow-up testing plan. The employer is responsible for ensuring those follow-up tests are carried out if the driver returns to safety-sensitive work.

Employer FAQs

Questions from trucking companies, fleets, owner-operators, and other DOT-regulated employers.

1. What are an employer’s responsibilities after a driver violation?

Employers must follow DOT and FMCSA requirements, including Clearinghouse use, required reporting, and return-to-duty procedures if they decide to allow the driver back into safety-sensitive duties.

2. Do employers have to use the Clearinghouse?

Yes. FMCSA-regulated employers must use the Drug & Alcohol Clearinghouse for required queries and reporting related to CDL driver drug and alcohol program violations.

3. What is the difference between a full query and a limited query?

The Clearinghouse distinguishes between full and limited queries for employers. We can help employers understand when each is used and how to stay compliant with query and consent requirements.
